Argentina sanctions online gambling code after overhaul of gambling framework

Argentina has its first online gaming code, operational in the province of Buenos Aires, after the executive of Buenos Aires promulgated the mandate of“2019 Finance Law”, which revamps BA’s play environment.

Last December, BA districts approved Decree 181 of the 2019 Budget Law, authorizing the granting of seven BA online gambling licenses, serving the provisions relating to sports betting, online casinos, poker and gambling. horse races.

Supervised by the ‘IPLyC – Council of Argentine Provinces for Lotteries and Casinos’, the province of BA will begin its licensing process for its first seven online licensees.

Argentine news sources report that the IPLyC has set a qualification criterion of 20 minimum conditions for interested parties to obtain a license – including disclosure of financial liquidity, industry experience and a number of data / security provision.

International companies will be allowed to compete for BA licenses, but will be required to maintain a physical commercial presence in the province of BA.

Despite the progress of its gaming program, the BA executive added a number of final changes to the decree, implementing a new tax policy for online gaming.

BA will maintain its previously approved 15% tax on online gaming revenue, but will add an additional 8% tax on individual verticals, combined with a 2% levy covering BA’s licensing terms and costs.

A key directive of BA Governor María Eugenia Vidal (Argentina PRO), the majority of taxes on online games will be used to fund BAs ‘FIDES – Social Development and Integration Fund’.

Although Governor Vidal passes Decree 181, the BA’s online gambling framework is expected to be challenged by the Superliga and FA Argentina (AFA) governors – which in March demanded that the president Mauricio Macri suspend the motion.

Argentina’s football governing bodies have insisted they will place an injunction on Decree 181, unless Vidal and Argentina PRO draft the gaming mandate, instituting rewards for football clubs.
